The Administrative Court of Appeal rejected the interim application of eight community councils for the suspension of the execution of a planning permit regarding the creation and operation of an asphalt concrete production unit in an area near the Mitserou community.
The application, according to an announcement by the Legal Service, was registered by the communities of Mitseros, Agrokipia, Agios Ioannis Nicosia, Kato Moni, Aredi, Menikou, Malounta and Orounta, which requested the suspension of the license pending the adjudication of the pending appeal.
The case concerns the relocation of the bituminous concrete production unit from the residential area of Dali to an area near Mitsero. Previously, the Administrative Court had rejected the appeal of the eight community councils, upholding the granted planning permission.
According to a statement from the Legal Service, the Court of Appeal, by a decision of the majority of the judges, examined the application on its merits and ruled that in the present case neither obvious illegality nor irreparable damage, including in relation to the environment and public health, as claimed by the communities, is documented.
At the same time, the minority decision stated that the application had no procedural background and should therefore be rejected.
The Administrative Appeals Tribunal gave directions to the parties involved for a short hearing of the appeal.
The case, on behalf of the Attorney General of the Republic, was handled by the Senior Attorney of the Republic Theodora Piperi Christodoulou and the Attorney of the Republic Thasos Hatziloukas.
